Welcome to the send cash function in YIBI Pay.

This payment feature is provided to you through YIBI Pay. It allows you to: (A) contact and procure services from such licensed third-party service providers ("Service Providers") to transfer funds to your intended recipient ("SCSP") through YIBI Pay/send cash functionality to trade digital assets directly with other counterparties. For clarity, SC functions in these terms refer to the functions mentioned in (A) and (B) of this paragraph.

These Terms, together with the additional specific terms listed in the Appendix below (if any) or incorporated herein pursuant to these Terms (collectively, the "SC Terms"), together constitute the legal agreement between you, the user of the "SC Terms" Binding Agreement. Please read these SC Terms carefully as they govern your access to and use of the SC features in YIBI Pay. Acceptance and Modification of SC Terms

By using the SC function, you acknowledge and agree that: (a) you have read, understood, accepted and agreed to be bound by these SC Terms, our YIBI Terms (<https://yibi.co/cn/help_more/5>) and our Privacy Policy <https://yibi.co/cn/help_detail/13/5> (YIBI Terms, YIBI Pay Terms of Use and our Privacy Policy should be read together with and in addition to these SC Terms); (b) You understand and shall bear all risks associated with transactions involving cryptocurrency; (c) we are not responsible for any such risks or adverse outcomes related thereto.

We may change or modify these SC Terms, or add new features or remove existing features and change any part of the SC functionality, at any time in our sole discretion. For any changes or revisions to these SC Terms, such changes will be effective on the “Last Revised” date mentioned at the top of this page. Additionally, you acknowledge and agree that we may, but are not obligated to, notify you of any changes to SC features or these SC Terms. In this regard, you agree and undertake to refer regularly to these SC Terms and any other announcements we may make from time to time through any communication channels we deem appropriate.

We may also, in our sole discretion and without notice or liability: (a) change, suspend or discontinue any aspect of the SC functionality at any time, including without limitation the availability of any features, products or services: by service providers List and make available for you to purchase; (b) impose restrictions or conditions on certain SC functions, or restrict your access to any part or all of the SC functions; (c) cancel, deny or refuse the transactions you initiate in the SC functions of YIBI Pay any requests that are deemed to be in breach of these SC Terms or any other terms and conditions that may apply to you (including those imposed by third parties) of your service provider (if any).

Unless expressly defined in these SC Terms, or the context otherwise requires, all words and expressions used in these SC Terms shall have the same meaning as defined in the YIBI Pay Terms of Use or the YIBI Terms. For clarity: (a) "YIBI Services" as defined in the YIBI Terms shall include SC functionality; (b) "YIBI Pay" has the same meaning as defined in the YIBI Pay Terms of Use; (c) If these SC Terms are inconsistent with YIBI Pay Any conflict between the Terms of Use or the YIBI Terms (as the case may be) shall be resolved in a manner most favorable to YIBI and/or its affiliates, always subject to any restrictions, limitations or prohibitions imposed by applicable law.

Unless otherwise provided in the specific terms of the SCSP, the Service Provider is solely responsible for providing the SCSP Services to you (including, without limitation, their quality, performance or availability) and for resolving any and all disputes related thereto.

Transactions using your own account: By accessing and using the SC functionality in YIBI Pay, you represent and warrant that all activities under your account are conducted by you. You may only trade on your own account using the SC Features and SCSP Services and may not trade on behalf of any other person or entity.

Understanding You: Without prejudice to the generality of any other rights we or the Service Provider may have under the YIBI Terms, these SC Terms or any other terms agreed between you and us, you further acknowledge and agree that we and/ or service provider. As part of providing services to you, the provider may be required by law to conduct all necessary security and customer due diligence on you (including parties involved in the transaction you request, such as your recipients). Accordingly, you agree that you will comply with any request from us or the Service Provider for more information, if requested, and to provide such information in a format acceptable to us or the Service Provider. Additionally, you authorize and agree that we and the Service Providers may make, directly or through any third party, any inquiries that we or the Service Providers deem necessary to verify information provided to us and/or the Service Providers.

8.
Cancellations and/or Refunds for Services You Purchase from Service Providers: Unless otherwise provided in the specific terms of the SCSP, all cancellations/refunds for any request initiated by you through the SC functionality will also be processed by the Service Provider. We are not responsible for the administration of refund/cancellation fees (if any) charged by service providers. The Service Provider is also solely responsible for the SCSP Services it provides directly to you. However, you can contact us to raise your query with the relevant service provider for resolution.

By initiating a transaction using the SC function, you agree to: (a) Pay any fees that may be charged; (b) We deduct the corresponding amount of cryptocurrency from your YIBI Pay wallet. Converting your chosen cryptocurrency to USDT (for sending USDT to the service provider, if applicable) may also include spreads. For further details regarding applicable fees (if any), please refer to the YIBI Pay Features Page (or other such pages we may provide as specified), which may be modified or updated from time to time in our sole discretion.

For clarity: (a) Section 6 of the YIBI Pay Terms of Use (“Usage Regulations and Permitted Conduct”) also applies to your use of the SC Features

You further agree that you are solely responsible for configuring your information technology, computer programs and platform to access our SC features and service providers' SCS. You should use your own virus protection software. You also must not abuse the SC functionality and/or SCS by introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You may not attempt to gain unauthorized access to our or our service providers' servers, computers or databases. In the event of such a breach, your right to use our SC features and to utilize the Service Provider's SCS will terminate immediately.

Representations and warranties

12.
You represent and warrant that:

(A)
Not Allowed as a Currency Trading Platform: You may not use our SC functionality as a currency trading platform (including, but not limited to, creating a series of transfers without inadvertent completion or seeking to profit from crypto-to-crypto/fiat exchanges). If we or the service provider detect that you are using the service for these inappropriate purposes, we or the service provider may, at their sole discretion, set limits on the number of instructions you send through the SC function in the YIBI Pay platform, cancel your instruction instructions, or impose Other restrictions that we or our service providers may deem appropriate. Such restrictions may include, but are not limited to, the amount and type of currency that your intended recipients can receive, and your ability to use this or other features in the YIBI payment platform, etc.

Personal use: You use our SC functionality for personal and private use (if you use the SC functionality for any business or commercial purpose, we will not be liable to you for any loss of profit, business loss, business interruption, business loss) Opportunities or indirect losses).

(C)
Comply with Third Party Requirements (if applicable): You will fully comply with and comply with any and all user requirements and requests (if any) that we may notify you from time to time (including without limitation requirements or requirements imposed by service providers from time to time), regardless of Whether through amendments to these SC Terms or otherwise. You further agree that your compliance with and compliance with any and all such user requirements and requests shall be a condition of providing SC functionality to you.

Compliance with Laws: You will comply with all laws and regulations applicable to the use and operation of the SC Features, and you will not use any services within the SC Features in connection with or in connection with any illegal or fraudulent activity. You also agree to provide us (and the Service Providers, as applicable) with such assistance and information (including documentation) as may be reasonably requested from time to time to enable us and/or the Service Providers to comply with all applicable laws and regulations.

(A) Whenever you select and use SCSP Services made available to you through the SC Features, you acknowledge and agree that such Services are provided solely to you by the Service Provider through us on an "AS IS" and "AS AVAILABLE" BASIS. " BASIS. (B) TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DO NOT WARRANT, WE EXPRESSLY DISCLAIM, AND YOU AGREE TO WAIVE, ANY AND ALL OTHER WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY , fitness for a particular purpose, title, or non-infringement or warranties arising out of course of performance, course of dealing, or trade usage. Without limiting the foregoing, we do not represent or warrant that: (a) SC FUNCTIONS, ITS CONTENT or that the SCSP services provided hereunder are accurate, complete, reliable, up-to-date, error-free or free of viruses or other harmful components; (b) the quality of the services provided by third-party service providers (if any), or their reliability, availability or the ability to meet your needs.

To the maximum extent permitted by law (and without limiting any other provision in these SC Terms), we and our YIBI Affiliates hereby exclude any loss or damage of any kind caused to you or any other person (howsoever caused or incurred) ) all liability arising out of or in connection with: (a) the provision of SCSP services (including, without limitation, their quality, performance and/or their availability) to you by the Service Provider, notwithstanding your access through our SC functionality Such SCSP services;

You further understand and agree that we will not be liable to you or anyone else for any errors, delays, losses, or damages arising out of or related to: (a) any inaccuracies, defects, or omission; (b) any interruption, error or delay in data transmission or processing of your request by us, YIBI affiliates or service providers; (c) related to or resulting from SCSP services performed entirely for you by service providers Any service interruption or system downtime resulting. Such services include, but are not limited to, service providers transferring fiat currency to your intended recipient (d) any scheduled or unscheduled maintenance performed by us and/or our other partners (including service providers) in providing SC functionality or SCSP services to you (as the case may be); (e) any damages caused by the acts, omissions or breaches of these Terms by other users; (f) caused by the illegal acts of other third parties or acts not authorized by us any damages caused; (g) other exemptions mentioned in our published disclaimers and Platform Rules.

You further agree that you and your intended recipients shall bear all risks associated with your use of and reliance on the Service Provider’s services. Accordingly, you also agree not to make any claim against us or our YIBI affiliates with respect to your use of and reliance on the Service Provider; when you use the SCSP Service, if any error, loss or delay results from any defect (due to System downtime, planned or unplanned maintenance or other reasons), seek recourse only from the Service Provider, if any, for delays or failures in the Service Provider's provision of services to you.

You agree to indemnify and hold us, our YIBI affiliates, service providers, and each of our or their officers, directors, agents, joint venturers, employees and representatives harmless from any claim or demand, including attorneys fees and any losses, fines, fees or penalties imposed by any regulatory authority, or other damages asserted against us by third parties) arising from: (a) your use of SC features or in connection with your request, receipt and access to SC Function-related conduct (which includes receiving SCSP services from a Service Provider); (b) Your violation of these SC Terms, or any other terms agreed between you and us, or any law or regulation. For clarity, our rights to indemnification under these Terms are in addition to the rights and protections conferred on us by the YIBI Terms and the YIBI Payment Terms of Use.

You shall be bound by all terms set forth in the YIBI Privacy Policy, which shall be read in conjunction with and in addition to these SC Terms. You also acknowledge and agree that: (a) we may share with our service providers (including, but not limited to, service providers as defined herein) if our service providers need such information for legal and regulatory compliance The purpose for which you provide us with information, or as part of the provision of services to you. In this case, the processing of your data will be in accordance with our YIBI Privacy Policy; (b) all data you provide to the Service Provider through the YIBI Payment Platform will be collected and processed by the Service Provider in accordance with the Service Provider's Privacy Policy .

General

19.
You should also abide by the "YIBI Terms" and "YIBI Payment Terms of Use"

Subject to all terms set forth in these Terms and Conditions, these Terms and Conditions shall be in addition to these SC Terms. Therefore, the rights and protections given to us by the "YIBI Terms" and "YIBI Payment Terms of Use" also apply and are supplementary to these rights and protections. Provided to us subject to these SC Terms.

20.
For clarity, the provisions of the YIBI Terms regarding "Dispute Resolution: Forum, Arbitration, Class Action Waiver" shall apply fully to your access to and use of this SC feature as expressly provided in these SC Terms.
